Terms and Conditions

These Terms and Conditions apply to all purchases made via the Rooted in Bolton CIC website. By placing an order, you agree to be bound by these Terms.

Nothing in these Terms affects your statutory rights.

1. Product Information

We take reasonable care to ensure product descriptions, specifications and pricing are accurate.

Colours may appear differently depending on screen settings and device type. If you are unsure about any product details, please contact us before placing your order.

All prices are shown in GBP and include VAT at the standard UK rate unless stated otherwise.

We reserve the right to correct errors in product listings, descriptions or pricing at any time.

2. Orders and Contract Formation

After placing an order, you will receive an automated confirmation email. This does not constitute acceptance of your order.

A legally binding contract is formed only when goods are dispatched.

We reserve the right to refuse or cancel any order where:

• The item is unavailable

• A pricing or listing error has occurred

• Fraudulent or suspicious activity is suspected

If we cancel an order prior to dispatch, a full refund will be issued.

3. Payment

Payment must be made in full at the time of ordering unless a staged Pre-Order payment option is clearly offered at checkout.

We use third-party payment providers. We are not responsible for delays or errors caused by those providers.

4. Delivery

Delivery options and costs are shown at checkout.

Estimated dispatch times:

• Mainland UK - 1-2 working days dispatch, 1-2 working days delivery

• Highlands and Islands - 1-2 working days dispatch, 3-5 working days delivery

Delivery timeframes are estimates and not guaranteed.

Risk in the goods passes to you upon delivery.

If goods are returned to us due to incorrect address details provided by the customer, failure to collect, or refusal of delivery, we reserve the right to deduct the direct costs incurred in returning and re-dispatching the goods.

5. Your Right to Cancel - Consumer Contracts Regulations 2013

If you are purchasing as a consumer, you have the right to cancel your order within 14 days of receiving your goods.

To cancel, you must notify us by email at orders@rootedinbolton.co.uk within 14 days of delivery.

After notifying us, you have a further 14 days to return the goods.

Refunds

If you cancel within the 14-day period:

• You will receive a refund of the purchase price

• The original standard delivery charge will be refunded

• You are responsible for return postage unless the goods are faulty

Refunds will be processed within 14 days of us receiving the returned goods or receiving evidence that they have been sent back.

We may make a deduction for any loss in value resulting from handling beyond what is necessary to establish the nature, characteristics and functioning of the goods.

6. Faulty, Damaged or Incorrect Goods - Consumer Rights Act 2015

Goods must be:

• As described

• Of satisfactory quality

• Fit for purpose
  

If goods arrive damaged, faulty or incorrect, you must notify us as soon as reasonably possible at orders@rootedinbolton.co.uk, providing your order number and photographic evidence where applicable.

We will arrange a replacement or refund in accordance with your statutory rights.

Where goods are confirmed faulty, we will reimburse reasonable return postage costs.

7. Returns Outside the Statutory Cancellation Period

Returns requested outside the 14-day cancellation period may be accepted at our discretion.

Where accepted:

• Goods must be unused and in resalable condition

• Return postage is the responsibility of the customer

• A restocking or administrative charge may apply

This section does not affect your statutory rights in relation to faulty goods.

8. Pre-Orders and Limited Edition Colours

Pre-Orders allow customers to reserve stock not currently held in our physical inventory.

Certain limited edition colours are not standard stock items and are ordered based on customer demand.

Where a staged payment option is offered:

• Payment terms will be clearly outlined at checkout

• Full balance must be paid before dispatch

Pre-Orders may be cancelled before dispatch for a full refund.

Once delivered, Pre-Orders are subject to the same statutory 14-day cancellation rights as all other products.

As limited edition colours are not normally stocked, customers are advised to ensure they are certain of their choice before placing a Pre-Order.

9. Packaging

In line with our environmental ethos, packaging may be recycled or reused materials. This does not affect product quality.

10. Limitation of Liability

Nothing in these Terms limits or excludes liability for:

• Death or personal injury caused by negligence

• Fraud or fraudulent misrepresentation

• Any liability that cannot legally be excluded

Subject to the above, our total liability shall not exceed the total amount paid for the goods in question.

We are not liable for indirect or consequential losses.

11. Force Majeure

We shall not be liable for failure or delay in performing our obligations where such failure results from events beyond our reasonable control, including but not limited to acts of God, extreme weather, carrier disruption, or supply chain interruption.

12. Governing Law

These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.

13. Amendments

We reserve the right to amend these Terms at any time. The version in force at the time of purchase will apply to your order.
